California
is a simple and efficient way for parties to settle a dispute via pro-per. It
is very cost effective and the entire process is relatively quick. For
individual plaintiffs, the maximum you can sue and recover is $7500.00.
If you are suing as a business entity, the maximum you may sue for and
recover is $5000.00. The fundamental steps are as follows: (1) Prepare and file
your “Plaintiffs Claim and Order to go to Small Claims Court” with the
appropriate court venue (2) Serve the defendant with a copy of the Plaintiff’s
Claim, and (3) File your proof of service with the court. A court trial
is generally set approximately 45-60 days away and you are allowed to subpoena
witnesses and / or records you may feel are essential to aid your case.
The defendant must be served within the time restrictions provided. When you go
to court you will present your case directly to the judge or
commissioner. The
defendant will then have an opportunity to present their side. The judge will
then make a ruling. The entire process is conducted in a simple and
understandable fashion.
