Arbitration Services

Arbitration is an alternative dispute resolution which involves disputing parties who will present their disagreements to an unbiased third party for the objective of rendering a solution to the issue.  Its purpose is to provide an incentive for the speedy, fair, and economical resolution of controversies by informal procedures while preserving the right to a conventional trial.  The impartial Arbitrator makes a determination based upon evidence which is presented during the arbitration process.  The arbitrator will then submit an arbitrator’s award to the court and the parties shall honor the valid award in accordance with that arbitration agreement. Should a party fail to honor the award, the other party may still seek relief from the courts. Unless a party has filed a written demand for a trial de novo within 30 days after the arbitration decision/award was filed with the Court, that decision/award shall become a final, non-appealable judgment of the Court.

 

The Arbitrator is a private, unprejudiced, however experienced neutral, mutually appointed by the parties. The arbitration is held in a confidential manner at a time and location which will suit each party.

 

Our arbitrators are skilled attorneys who may serve as a 3-person arbitration panel or as a single independent presiding neutral where only one arbitrator is required. Our Arbitration areas of practice include:

 

Any civil matters may be arbitrated not involving prisoners as party litigants.  Contracts, Real Property Contracts, Property Lines, Encroachments, Labor & Employment Discrimination, Workplace Matters, Age, Gender, National Origin, ADA, Reasonable Accommodation, Adverse Environment.  Also, Insurance Matters & Bad Faith Claims, such as all insurance matters including Coverage, Breach of Contract, Bad Faith, Punitive Damages, and other Insurance Transactional Disputes.

 

Arbitration Fees:

Arbitration fees range from $200.00 to $500.00 per hour depending upon the nature of hearing and arbitrator chosen. Arbitrations, on average require the use of a neutral administrator so disputing parties and the arbitrator do not have direct communication prior to the hearing. Elite Attorney Services, LLC can also administer your arbitration if you do not choose to utilize the services of an independent administrator.

 

Cancellation Policy for Arbitration sessions:

For cases reserved through the Elite Attorney Services, LLC office, there is no consequence for cancellation of the Arbitrator’s reserved time, as long as our office receives written notice at least 30 days prior to the scheduled date of arbitration. Cancellations and/or continuances that are received within the 30 day period may be subject to a loss of fees paid for the time which was reserved for your Arbitrator. Loss of fees, if any, shall be at the discretion of the Arbitrator reserved for your case.
